Funeral activities

Craft is an independent and permanent performance of permitted economic activities by individuals with purpose of achieving income or profit through production, trade or service providing on the market. Enrollment of a new craft in the craft register, termination of a craft, and all status changes of a craft is carried out by decision making in administrative procedure and issuing a craft certificate.

Establishment of a craft:

Application for registration in the craft register is submitted by filling out the prescribed form – Application for registration in craft register, which contains information about the owner of the craft, about the craft itself and activities of the craft in accordance with the National classification of activities.

Crafts in the sense of  the Act of crafts can be:

  • Free crafts for which professional qualification exam, masters exam or appropriate prefessional training is not required as a condition,
  • Related crafts for which professional qualification exam, appropriate high school diploma or masters exam is required as a condition,
  • Privileged crafts which the craftsman can perform only on the basis of priviledge, i.e permit issued by competent ministry, depending on activities of the craft.

The craft is established in the Administrative departmen for economy and agriculture of Virovitica-Podravina County, according to the place of the craft’s headquarter – Virovitica, Slatina, Orahovica, Pitomača.

e-Craft – online application for craft registration

Electronic service e-Craft is provided by the Ministry of economy and sustainable development through the e-Citizen system, through which current or future craftsman can submit an application for the craft establisment, or enter status changes without personally coming to the competent registration body, and the craftsman is receiving  his craft ceftificate, decision on opening a craft, and excerpt from the Craft Register through his personal user mailbox, after the procedure has been carried out.

START – online application for craft registration

Entreperneurs in Croatia can start their businesses through the digital service of the Republic of Croatia Government  – START. It is an information system which enables quick and simple electronical business start-up.

Precondition: credential possesion, which means electronic identification card or FINA ceftificate.

EU citizens: they can use e-Citizen system in the Republic of Croatia by using their national credentials, i.e. means of confirming their electronical identity, recognized in the EU cross-border identification system.

Application for registration in Craft Register is submitting by filling in the prescribed form – Application for registration in Craft Register (2 copies). The application contains information about the owner of the craft, about the craft itself, name and numerical marks of the craft.

Along with application for registration, following documents and evidences are needed:

  • Copy of the craft owner’s identity card
  • Proffessional trainig certificate or certificate of passing masters exam (for related crafts) for owner or an expert if the owner himself does not meet the requirements of a related craft
  • Evidence of the right to use the premises – contract for the lease of a business space or excerpt from land register, consent from co/owner and a copy of premises co/owner’s identity card
  • Medical certificate on work capacity for jobs with special health work conditions
  • Partnership agreement if it is joint performace of a craft

Certificate of impunity and pronounced measures of the Court of Honor are obtained by official duty upon receiving the request.

The company is the name under which the craft is operating and it contains the name of the craft, mark of the craft, first and last name of the craftsman and headquarter of the craft. Name of the craft must be clearly different from the name of another craft based in the Republic of Croatia. Therefore it is necessary to determine the factual situation by checikng the website Portor.hr whether is there an active craft with identical name already.

When registering in the Craft Register, names and numerical marks of craft activities are entered according to the National classification of activities (NKD 2007 with explanations). National classification of activities is the classification of all economic activities of the Republic of Croatia.

Related crafts, degree and type of professional trainig required for their performance, list of privileged crafts and method od issuing privileges are prescribed by The Ordinance on conected and privileged crafts and the method of issuing privileges (NN no. 42/08, 114/11, 143/13).

If the craft is registered in the Craft Register without starting the work performance, the craftsman is obligated to start performing the craft within one year from the day of issuing the craft certificate. No later than 8 days before the start of the craft performance, the craftsman reports it on the form  Application for registration in Craft Register. If the craftsman does not start the craft performance within one year or does not notify this Administrative department about beggining of the craft, the craft ceases by force of law. Before starting performing craft of trade, hospitality and transport activities, craftsman is obligated to request determination of minimum technical conditions for space and equipment for trade and hospitality activities, or determination of legaly perscribed conditions for the vehicle for transport activities. Only after reaching the decision on minimum techincal conditions, can the party (trader, caterer, carrier) start with performing activities.

TRADITIONAL AND ARTISTIC CRAFTS

Traditional crafts are crafts which require special knowledge of craft skills and performance of activities skills, which are performed with the majority of manual work and rely on the patterns of traditional culture in terms of production and work techniques, purpose and form. In this sense they can symbolize local, regional and nacional identity.

Artistic craft are crafts that are distinguished by products and services of high aesthetic value, design, artistic and other solutions with emphasized creativity and individuality of the craftsman – the artist.

Conditions and method of acquiring the status of traditional or artistic craft are prescribed by the Ordinance on traditional or artistic crafts (NN no. 112/07).

HOMECRAFT AND SECONDARY OCCUPATION

Homecraft is understood as production performed by individual person at home, if it meets requirements from regulations which regulates individual activity. In the application for registration into the records, individal must specify all of the products he will be making at home.

Secondary occupation is understood as performance of service activities at home by personal work, i.e. at customers home. Individual can perform services as a secoundary occupation if he meets  professional qualification special condition , appropriate vocational educaation or passing a masters exam , if he is performing an activity from the list of related crafts.

Along with application for registration, following documents and evidences are needed:

  • Copy of the craft owner’s identity card
  • Proffessional trainig certificate or certificate of passing masters exam (for related crafts)
  • Excerpt from the land register and owner’s consent for the facility where the homecraft or secondary occupation is located, which is the address of residence or domicile of individual who performs homecraft or secondary occupation
  • Proof of the right to use the premises – lease agreement or extract from the land register and consent of the owner
  • Proof of meeting special health conditions, if prescribed by special law
  • Confirmation that the taxpayer is not registered in the register of taxpayers based on self-employment, that he is not in the value added tax (PDV) system, and that he is not registered as an income tax payer based on self-employment in agriculture.

Administrative fee:

Administrative fee for registration in the Craft Register, issurance of autorization for performance of homecrafts, secoundary occupation is not charged.

LICENSES

Request for issuance of a license for transport of goods and passengers in domestic road traffic, licenses for auto taxi transport, licenses for special forms of transport in domestic road traffic (renting a vehicle with a driver as a special form of transport), licenses for bus and cargo stations, licenses for performing agency work activity as an intermediary activity when hiring transport capacities of carriers and issuing a certificate for carrying out cargo and passenger transport for own needs.

Administrative fee:
Depending on the type of license, according to tar. no. 15 of the Regulation on the tariff of Administrative Fees (NN no. 92/21, 93/21 i 95/21).

LICENSE FOR PERFORMING PUBLIC TRANSPORT IN DOMESTIC ROAD TRAFFIC

Based on the Law on Road Transport (NN no. 41/18, 98/19, 30/21, 89/21) public road transport activities in the field of domestic and international road transport can be carried out by a carrier (legal entity or individual person) if it is registered for the performance of public road transport activities and if it meets the conditions prescribed by this Act, i.e. the Ordinance on Licenses in Road Transport traffic (NN no. 50/18).

Obligee: Each carrier (individual person – craftsman and legal entity) registered for the performance of public road transport activities is obligated to submit an application for the issuance of a license for the performance of passenger, cargo, auto taxi transport activity in domestic road transport before bussines performance beggins, in accordance with Article 7 and 8 of the Law and Article 3 of the Ordinance (the license for performing activities of passenger and cargo transportation in international road transport is issued by the Ministry of the Sea, Transport and Infrastructure).

Along with the request, the party is obligated to attach evidences of fulfillment of the conditions prescribed by law:

  1. Evidence of transport activity registration in the register: craft certificate decision of the Commercial Court
  2. Evidence that the carrier owns or leases at least one vehicle: a certified copy of the traffic license, i.e. vehicle rental or leasing contract
  3. The autotaxi carrier is obligated to submit the first records, which must at least contain:
  • name, surname and residence of individual person – craftsman of autotaxi carrier, i.e. company name and registered office of the legal entity of autotaxi carrier
  • autotaxi carrier’s OIB
  • registration and VIN number of the active vehicle used for autotaxi transportation
  • model year of the vehicle according to the VIN number of the vehicle
  • manufacturer’s name and vehicle model.

REMARK: All changes in records, after obtaining the license, autotaxi carrier is obligated to submit to the license issuer within 8 days from the date of the change, in a way to submit the latest updated version of the records and the list of changes of deleted and registered vehicles in relation to the last records that he submitted to the licenses issuer, where the submitted updated record or list of changes must contain the date of deletion or entry of each individual vehicle in the subject record. Changes in records can also be submitted via e-mail.

  • Evidence of financial ability:
    • Carrier fulfills the condition of financial ability if, at disposal assets, he owns the amount of at least €9,000 for the first vehicle and €5,000 for each subsequent vehicle. Exceptionally, for purpose of obtaining a license to carry out the transportation of passengers in vehicles that, in addition to the driver’s seat, have a maximum of eight seats (personal car category M1), it is considered that the domestic carrier has financial capacity, at disposal assets, if he owns the amount of at least €3,000 for the first vehicle and €1,500 for each subsequent vehicle.
    • Financial ability is proven by one of the following pieces of evidence: an excerpt from the appropriate register on the amount of the founding capital; or a copy of the balance sheet submitted to the tax administration; or a list of fixed assets, proof of purchase and payment of vehicles, devices, equipment or business premises; or ownership certificate for unencumbered properties; or contract on dedicated deposit in the bank; or bank or other financial institution guarantee on creditworthiness; or confirmation of available funds.

REMARK: A carrier that perform autotaxi transportation of passengers proves his financial capacity with a valid insurance policy for all passengers in the vehicle used for autotaxi transportation, which was concluded in accordance with a special regulation which regulates mandatory insurance in road traffic.

  • Proof of professional qualification of person responsible for transport: a certificate of professional qualification or a copy of a diploma in the field of transport and a copy of the work book; or a copy of Commercial Court decision or craft certificate and a copy of the work book, i.e. performance certificate of transport management tasks and a copy of the work book.
  • Evidence that the carrier has a good reputation for a legal entity and transport manager in a legal entity and an individual person craftsman: certificate of impunity from the Ministry of Justice, the Administration for Criminal and Misdemeanor Records (obtained by this Administrative Department by official duty), concluded contract on the management of transport operations.
  • Evidence that there is no debt for tax obligations and obligations for pension and health insurance, which is proven by a certificate not older than 30 days from the date of submitting the application for the issuance of a license
  • Administrative fee in the amount of 92,91 EUR (payment via general payment slip) – an excerpt from the license for each individual vehicle is additionally charged 4,65 EUR

LICENSE FOR PROVIDING STATION SERVICES

Based on Article 99 of the Law on Road Transport (NN no. 41/18, 98/19, 30/21, 89/21)and the Rulebook on Licenses in Road Transport Activities (NN no. 50/18) the activity of providing station services can be performed by a legal entity or individual person who is registered to perform this activity and owns or leases a bus station facility and has a license to perform this activity. The license referred to in paragraph 1 of this article is issued by the competent administrative body of the county or the City of Zagreb, whose scope includes the performance of entrusted state administration tasks related to road traffic.

Conditions for obtaining a license (in addition to conditions specified in Article 16):

  • equipment of the bus station in accordance with conditions of the Ordinance on Bus Stations (NN no. 57/2018)
  • administrative fee in the amount of 139.36 EUR (payment via general payment slip)

LICENSE FOR PERFORMING AGENCY ACTIVITIES

Based on Article 96 of the Road Transport Act, agency activity in road transport can be performed by a legal entity or individual person – a craftsman, who meets the following conditions (in addition to the conditions specified in Article 16)

  • business space with a highlighted company at the entrance, which is suitable for business, completely separated from the residential area and which enables the unhindered performance of the activities of an agent in road transport
  • concluded liability insurance contract for damage that could be caused to the carrier, the transport orderer or a third party by performing agency activities (the lowest insured amount cannot be less than 19,908.42 EUR, i.e. 99,542.10 EUR for all compensation claims in one insurance year)
  • administrative fee in the amount of 139.36 EUR (payment via general payment slip)

TRANSPORTATION OF PEOPLE AND CARGO FOR OWN NEEDS

Transportation for own needs is the transportation of persons or cargo performed by individual persons – craftsmen or legal entities as logistical support for their basic activity, where the basic activity is impossible to perform without such transportation, and the transportation activity is only an auxiliary activity of that person in performing the main activity, and which does not have characteristics of other forms of transport.

Vehicles used for transportation for own needs must be owned by the carrier who is performing transportation for his own needs or must be leased by the carrier based on a rental or leasing contract or must be available for use based on another basis (sublease, etc.)

Vehicles which are used for personal needs transportation must be marked and equipped in accordance with the regulation from article 13. paragraph 7 of the Act on road transport.

Administrative fee in the amount of 66.36 EUR (payment via general payment slip).

An excerpt of the certificate for each individual vehicle is additionally charged 4,65 EUR.

A carrier who is performing transport for his own needs is obligated to report the same to the competent administrative body of the county in which it has its seat or residence.

The competent administrative body for transport affairs issues a Transport Registration for its own needs to the carrier by decision.

Registration of transport for own needs is issued for an indefinite period.

ISSUING ACCESSIBILITY SIGNS FOR MARKING VEHICLES IN WHICH PEOPLE WITH DISABILITIES ARE CARRIED

Based on Article 40 of the Road Traffic Safety Act (NN no. 67/08, 48/10, 74/11, 80/13, 158/13, 92/14, 64/15, 108/17, 70/19, 42/20) it is prescribed that persons with 80 percent or more of physical damage, or persons with 60 percent or more damage to their lower extremities, can mark the vehicle in which they are being transported with the prescribed accessibility sign. The accessibility sign is valid only when the vehicle is driven by a person with a disability referred to in paragraph 1 of this article, or when that person is in the vehicle.

The right arising from the accessibility sign cannot be used by a person who is not a person with a disability based on Article 2 of the Ordinance on the sign of accessibility (NN no. 78/08,87/14).

Accessibility sigh in issued by the competent administrative body of the county or the City of Zagreb.

Along with the request for the issuance of the accessibility sign, the party must attach:

  • report and opinion of an authorized expert of the Croatian Institute for Pension Insurance, the Institute for Expertise, i.e. the report and opinion of the second-level medical committee responsible for giving reports and opinions under the Act on the Rights of Croatian Veterans of the Homeland War and their Family Members or the Act on the Protection of Military and Civilian War Invalids or a decision on disability (damage of the lower extremities must be at least 60%)
  • applicant photo in size 35×45 mm
  • identity card copy
  • there is no administrative fee for issuing an accessibility sign

DETERMINATION OF MINIMUM TECHNICAL CONDITIONS FOR PERFORMING TRADE ACTIVITIES

Legal basis: Trade Act (NN no. 87/08, 96/08, 116/08, 114/11, 68/13, 30/14, 32/19, 98/19, 32/20) and Ordinance on minimum technical conditions related to sales facilities, equipment and resources in sales facilities and conditions for sale of goods outside stores ( NN no. 66/09, 108/09, 8/10, 108/14).

Obligee: Any legal entity or individual person registered for purchase and sale of goods (merchant), as well as other legal entity and individual person registered for production activity, when they sell their products at retail (family farms, associations, cooperatives, institutions, commercial fishermen and other).

Exceptionally, trade activities can be performed in sales facilities in accordance with the provisions of the Law without a new decision on fulfillment of the conditions, if a decision of the competent authority on fulfillment of the conditions for the performance of trade activities has already been issued for the same sales facility, if it concerns the continuation of the performance of trade activities, and in the meantime there have been no significant changes related to the sales facility, equipment and means used to carry out trade activities, if it is not about food and goods dangerous to life and health of people and animals, as well as nature and the environment.

TRADE IN SEEDS AND PLANTING MATERIAL

Legal basis: Law on seeds, planting material and recognition of agricultural plants varieties (NN no. 110/21)
Obligee: All persons involved in the sale of seeds and planting material.

TRADE IN PLANT PROTECTION PRODUCTS

Legal basis: Law on Sustainable Use of Pesticides (NN no. 46/22).
Obligee: All persons involved in the sale of plant protection products.

The request is submitted to the Administrative Department for Economy and Agriculture of Virovitica-Podravina County, according to the location of the craft’s headquarters – Virovitica, Slatina, Orahovica, Pitomača.

Application submission method:

  • by personally coming to the competent administrative body
  • via e-mail

Along  with the request, the party must attach:

  • Evidence of registration (Excerpt from the court register of the Commercial Court for legal entities, extract from the Craft Register for individuals)
  • Notification on the classification of the Central Bureau of Statistics (only trading companies)
  • Evidence of the right to use the building or business premises (lease agreement or extract from the land register)
  • Graphic solution that shows the square footage and description of the rooms
  • Evidence for use of the building in accordance with the Construction Act (NN no. 153/13, 20/17, 39/19,125/19)
  • Evidence of electrical installations correctness
  • Evidence of gas installations correctness and tightness (evidence of chimney functionality and maintenance)
  • Evidence of the ventilation correctness/functionality in trade of plant protection products and when thermal processing of food is carried out inside the store
  • Evidence of the heating elements correctness/functionality (air conditioners, heaters, stoves, etc.), if they are located in the building
  • Evidence of work environment testing
  • Evidence of administrative fee payment – for decisions on determining minimum technical and other conditions in business premises, they are charged to the giro account number:

  • Amounts of administrative fees as follows:
    • for sales facilities with an area of ​​up to 200 m2 ………17,25 EUR
    • for sales facilities with an area bigger than 200 m2 ..…37,16 EUR
    • for sales facilities where the trade activity is carried out outside the stores…..6,64 EUR

DETERMINATION OF MINIMUM TECHNICAL CONDITIONS FOR PERFORMING FUNERAL ACTIVITIES

Legal basis: Law on funeral activities (NN no. 36/15, 98/19).

Obligee: Legal entity or individual person registered in the appropriate register for the performance of funeral services is obligated to obtain a decision on the fulfillment of conditions for the performance of funeral services before starting the performance. The request is submitted to the local competent administrative body of the county in whose territory the  mortician headquarter is located.

Application submission method:

  • by personally coming to the competent administrative body
  • via e-mail

The request is submitted to the Administrative Department for Economy and Agriculture of Virovitica-Podravina County, according to the location of the craft’s headquarters – Virovitica, Slatina, Orahovica, Pitomača.

Along  with the request, the party must attach:

  • Decision or extract from the court or craft register
  • Evidence that the mortician meets the special requirement of professional qualification for performing funeral activities or employs a full-time worker who meets this requirement (Certificate of professional qualification, Employment contract)
  • Insurance contract for the case of damage liability caused by the performance of funeral services, for the sum of insurance in the amount of no less than 2,654.46 EUR per one harmful event, or 13,272.28 EUR for all compensation claims in one insurance year
  • Ownership or lease evidence for business premises or funeral center (Excerpt from the land register, lease agreement, etc.)
  • Ownership or lease evidence of at least one funeral vehicle and a certificate for that vehicle issued at the vehicle technical inspection station proving that it meets conditions for transporting deceased and remains
  • Ownership or lease evidence of a parking lot for funeral vehicles, i.e. that it has a place available where it can keep funeral vehicles in a way that meets minimum technical and organizational requirements for safe parking
  • Decision on meeting minimum technical, sanitary and other conditions of space and equipment for performing funeral activities
